We are a logistics company providing services of moving materials from one place to another place. For this we need to keep one fork lift permanently at manufacturer place for loading purposes for which we collect service charges based on no. of hours used. The manufacturer says he will provide required diesel for the forklift. Contract is entered with us saying that diesel shall be provided by him. The contract value is exclusive of diesel cost. We would like to know whether ST is chargeable on cost of diesel also although the same was supplied by the recipient of service. Pl clarify

No the service tax is not chargeable on the free supply of material provided by the service recipient as reading section 67 it is ample clear that the tax should be chargeable on the gross amount charged for service provided only. The landmark decision of Bhayana Builders PVT LTD {2013 (32) S.T.R. 49 (Tri. - LB)} clearly states that if the value of material is not included in the gross amount charged than it shall not form part of service provided and shall not be taxable. But the department is not accepting this decision and litigation is going on.
