PJ/Case Law/2018-2019/3502

Whether the parallel GST proceedings in two States are allowed U/S 70 of CGST Act,2017?
Case:  Shafi Khan Khokhar Vs State of Maharashtra
Citation: WRIT PETITION NO. 2951 OF 2018
Issue:Whether the parallel GST proceedings in two States are allowed U/S 70 of CGST Act, 2017?
Appellant’s contention:Mr. Anand Mishra represented on behalf of the   appellant. He is already being subjected to enquiry by CGST Authorities at Jaipur & new enquiry has been started in Mumbai. The basic contention of the petitioner is that two parallel proceedings / enquiries under the same subject are not to be done. Therefore, the appellant demands that the enquiries under the same subject at Mumbai being later in point of time should be void.
Respondent’s Contention and Judgement:The learned Counsel for the respodent points out that the petitioner has taken registration under the CGST Act 2017 & Finance Act, 1994 (service tax) in Mumbai. Thus, having taken registration, he is subject to the jurisdiction of Mumbai authorities in respect of the business within it. It is the case of the petitioner that primarily his business is at Jaipur.
This is more particularly so as Section 25 of the CGST Act 2017 provides for a separate registration in respect of each state. Once registration has been taken in Mumbai, then the petitioner is subject to the jurisdiction of Mumbai Authorities. Thus, no interference with the investigation at Mumbai is warranted.
If the original invoices are at Jaipur, then the zerox copies of invoice will be accepted by the Authorities at Mumbai as sufficient compliance.
Decision: Appeal rejected.
Comment: The Gist of the case is that when the petitioner has taken two registrations in two separate states then proceedings can be initiated by the respective authorities separately. There is no ambiguity in the same.
There is big issue of cross empowerment between state and central authorities. When a person falls under the jurisdiction of a particular authority then the action can be initiated by other wing. This issue is being debated by GST experts. Although this decision does not address the same but it has ruled that a person has two registrations as distinct person then separate proceedings for each registration can be started by jurisdictional authorities.
