Whether a part amount deposited sufficient for hearing the appeal?


Case:-M/S  P C SNEHAL CONSTRUCTION CO Vs CST, AHMEDABAD

Brief Facts:- There was non inclusion of cost of free material supplied to the appellant by the service recipient in the valuation of taxable service while Service Tax Valuation Rules provide for inclusion of free material supplied by service recipients. The appellant already deposited Rs. 9,04,000/- against the demand of Rs. 38.53 Lakhs for the entire period. This Stay Petition is filed by appellant for waiver of amount of Service Tax, Interest and penalties under Section 76 and 78 of Finance Act, 1994 as the amount deposited is enough to hear and dispose the appeal.
 
 
Appellant Contentions:- The Appellant said that the period involved in this case is covering the period in which the Service Tax liability was not in question and in part of the period post Service Tax valuation rules which came into statute. They have already deposited enough to hear and dispose the appeal.
 
Respondent Contentions:- The Respondent reiterates that post service tax valuation rules said inclusion of free material supplied by service recipients and as the appellant have defaulted in the same, stay should not be granted.
 
Reasoning of Judgment:- We have considered arguments on both the sides. The appellant has already deposited an amount against the demand for the entire period. All the legal issues raised by respondent can be considered at the time of final disposal of appeal. We consider the amount deposited by the appellant as enough deposit to hear and dispose the appeal. Accordingly, the application for waiver of pre-deposit of balance amounts involved is allowed and recovery thereof stayed till the disposal of appeal.
 
Decision: - Stay Granted.
 
Comment:This case states that stay can be granted even if the case is apparently against the assessee but the amount deposited by him is enough to hear the appeal.
