PJ/Case Laws/2011-12/1418

When pendency of appeal, no fault of assessee – stay granted till final disposal of appeal

Case:The Sirpur Paper Mills Ltd v/s CST, Hyderabad-I

Citation:2011-TIOL-84-CESTAT-BANG

Issue: -Stay granted by Tribunal till final disposal of appeal – when pendency of appeal not attributable to assessee – no coercive action can be taken against him – such action may amount to contempt of the Tribunal.

Brief Facts: -Against the order demanding service tax, appellant-assessee filed appeal before the Tribunal. The stay was granted till the final disposal of the matter. However, after completion of 180 days from stay order, the assessee filed application for continuation of stay and the Department also issued demand notice to the assessee for recovery of service tax demanded.

The miscellaneous application for stay is being heard.

Reasoning of Judgement: -The Tribunal took notice of the judgment of the Supreme Court in the case of CC&CE, Ahmedabad v/s Kumar Cotton Mills Pvt Ltd [2005 (180) ELT 434 (SC)] that sub-section 2A of Section 35C cannot be construed to punish the assessee for the matters which are completely beyond his control. Reference was also made to judgment in IPCL v/s Commissioner [2004 (169) ELT 267 (Tri-LB)].

The Tribunal held that stay granted by the Tribunal in appellant’s matter was meant to operate till final disposal of the appeal. The pendency of appeal was not due to any fault of assessee. Therefore, the stay order granted will continue till final disposal of appeal and no departmental action for recovery can be initiated. Any such action will be construed as contempt of this Tribunal.

Decision: -Miscellaneous application allowed.
