PJ/Case Laws/2011-12/1157

Service Tax on renting of immovable property - Locus standi of Tenant

Case: Devyani International Ltd. Vs. Union Of India & Ors.

Citation: 2011(22) S.T.R. 262 (Kar.)

Issue:- Service tax on renting of immovable property – tenant, being not a service provider, has no locus standi to challenge the levy.

Brief Facts:- Petitioner is a lessee of the scheduled premises. Department sought to impose service tax on renting on the Petitioner. The petitioner has filed writ petition challenging the levy.

Petitioner’s Contention:- Petitioner contended that prior to the amendment of Finance Act, 2010 what was permissible is, except for services provided other than by way of renting, the tax could be collected. But by the amendment, what is provided is service tax on renting itself.

Reasoning of Judgment:- The High court held firstly that the tenant is not a service provider. Secondly the payment of service tax, even if it is held to be valid on renting there is privity of contract between the landlord and the tenant.

The High court held that the petitioner being only a tenant in occupation of the premises which is let out by the landlord subject to the conditions in the contract, whether the landlord collect the rent and pays to the revenue or the landlord pays out of the rent amount without passing the liability on the tenant, is a different aspect. Since the petitioner is not a service provider, he has no locus standi to challenge the imposition of service tax on renting. As the tenant does not fall within the definition of service provider, therefore, the petitions are not maintainable.

Decision: - Petitions disposed off.

Comments:- This is very important decision as many tenants have also challenged the levy on renting. Thus, their petition is not sustainable in eyes of law as per this verdict. Meanwhile the hearing in Delhi High Court is going on and next date of hearing is on 20/05/2011.
