PJ/Case Laws/2011-12/1224

Reversal of 8%/10% of value of exempted goods under Rule 6 of CCR – modvat credit reversed – substantial amounts demanded as duty with interest and penalty paid – sufficient reasons for granting unconditional stay.
Case:M/s Royal Castor Products Ltd versus CCE, Ahmedabad

Citation:2011-TIOL-539-CESTAT-AHM

Issue:- Reversal of 8%/10% of value of exempted goods under Rule 6 of CCR – modvat credit reversed – substantial amounts demanded as duty with interest and penalty paid – sufficient reasons for granting unconditional stay.

Brief Facts:- Demand of duty was confirmed against the appellant in terms of provisions of Rule 57CC/Rule 6(3)(b) on the ground that since the appellants have not maintained separate accounts of input used in the manufacture of dutiable as well as exempted final product, they were liable to pay an amount of 8%/10% of the value of their final exempted product. In addition, penalty equal to duty amount stand imposed. Appellant is in appeal against the impugned order. Application for stay and waiver of pre-deposit is filed.

Reasoning of the Judgment:- The Tribunal held that it is seen that the appellants had deposited an amount against duty demand and further reversed the amount from their CENVAT account. Further, they have deposited some amount towards penalty and interest. By treating the same as sufficient for the purpose of Stay, the Tribunal allowed the Stay Petition unconditionally.
The Tribunal further noted that the disputed issue is covered by the precedent decisions of Tribunal inasmuch as it stand admitted in the impugned order of Commissioner(Appeals) that subsequent to start of proceedings against the appellant, they have reversed the MODVAT Credit involved in the input used in the manufacture of final product.

Decision:Stay granted till final disposal.
