PJ/Case Laws/2011-12/1410

Refund under Rule 5 of CCR, 2004

Case: COMMISSIONER OF CENTRAL EXCISE AND CUSTOMS v/s NBM INDUSTRIES

Citation: 2011-TIOL-677-HC-AHM-CX

Issue-cum-Brief Facts:- Whether manufacturer entitled to refund of cenvat credit on inputs used in manufacture of goods cleared by DTA units to 100 percent EOU under Rule 5 of the Cenvat Credit Rules, 2004?

Appellant’s Contentions:- Revenue contended that such a refund is not available since Rule 5 does not cover such a situation granting benefit of deemed export. It is submitted that only physical export would qualify for refund. Revenue have also relied upon the judgment of the Division Bench of the Madras High Court in a case reported in 2011 ELT 23.

Reasoning of Judgment:- The High Court relied upon judgment of the Division Bench of Ahmedabad High Court in Tax Appeal No. 968 of 2008 wherein it was held that the Tribunal has not committed any error in holding that the clearances made by one 100 percent EOU which are “deemed exports” are to be treated as physical exports for the purpose of entitling refund of unutilized cenvat credit contemplated under the provisions of Rule 5 of the CCR, 2004.

With regard to the judgment of the Division Bench of the Madras High Court relied upon by the Revenue, the High Court held that the Apex Court in the case of Virlon Textile Mills Ltd v/s Commissioner of C. Ex., Mumbai [2007 (211) ELT 353 (SC)]though not in identical situation while examining the nature of DTA sales to 100 percent EOUs observed that DTA sales against foreign exchange or other supplies in India can be equated with physical exports.

Decision:- Appeal dismissed.
