Power of remand - whether available to Commissioner (Appeal)

Case: Commissioner of C. Ex, Raigad v/s Positive Packaging Industries Ltd

Citation: 2011 (21) STR 644 (Tri-Mumbai)

Issue: - The Commissioner (Appeal) does not have power to remand the matter.

Brief facts: - Respondent-assessee had filed refund claim for CHA services and Commission agent services. The refund claim was rejected by the Original Authority. In appeal, the Commissioner (Appeal) held that the conditions prescribed in the Notification No. 41/2007-ST dated 06.10.2007 as amended by Notification No. 17/2008-ST dated 01.04.2008 and remanded the matter to the Original Authority to decide the issue afresh.

Against this order, Revenue is in appeal before the Tribunal.

Appellant’s Contention: - Revenue contended that the Commissioner (Appeal) has no jurisdiction to remand the matter and in case the Commissioner (Appeal) had any infirmity in the order passed by the original authority or that the order passed by the original authority is not sustainable, then the Commissioner (Appeals) has to pass himself the appropriate order in the matter. Reliance was placed on Mil India Ltd v/s Commissioner of Central Excise, Noida [2007 (210) ELT 188 (SC)].

Reasoning of Judgment: - The Tribunal perused the order of the Commissioner (Appeals) and held that the same disclosed that on the one hand Commissioner (Appeals) has held that the rejection of refund claim in relation to CHA as well as commissioner was not correct and at the same time ot was held that the claim has to be sanctioned after necessary verification. Thus, it was meant that the findings arrived at by the original authority was found fault with and was held to be sustainable but having said so the matter was remanded back.

The Tribunal held that it was well settled that the Commissioner (Appeal) had no power to remand the matter and he had to decide the matter by himself in case any infirmity is found in order-in-original. Impugned order set aside and matter remanded to the Commissioner (Appeal) to decide the matter. No opinion expressed on the merits of the case.

Decision: - Appeal and Cross objections disposed of accordingly.
