PJ/Case laws/2012-13/1069

Leviability of Service tax on Reimbursable charges - stay granted

Case: M/s PRAKASH SHIPPING AGENCIES V/S COMMISSIONER OF SERVICE TAX, CHENNAI

Citation: 2012-TIOL-227-CESTAT-MAD

Issue:- Brokerage received – service tax on reimbursable charges – prima facie case for pre-deposit made out.

Service tax charges paid banking commission, professional fees, additional expenses for crane charges & labour mammol – Pre-deposit ordered as no supporting documents furnished.

Brief Facts:- Appellant-assessee was receiving brokerage from shipping lines for CHA services provided for the period from 01.07.2003 to 31.07.2007. Department demanded service tax on the reimbursable expenses.

The Demand was confirmed by holding that appellant did not come within the ambit of ‘Pure Agent’.

Hence, Appellant is in appeal before the Tribunal. Application for stay and waiver of pre-deposit is filed.

Reasoning of Judgment:- With regard to demand on brokerage, the Tribunal found that the assessees have made out a strong prima facie for unconditional waiver in the light of the Tribunal’s order in LEE & MUIR HEAD PVT. LTD. V/S COMMISSIONER OF SERVICE TAX, BANGLORE [2009 (14) STR 348 (Tri-Bang)], which has been followed in the case of RUTH SHIPPING AGENCIES PVT. LTD. V/S COMMISSIONER OF CENTRAL EXCISE, THIRUNELVELI [2010 (19) S.T.R.39 (Tri-Chennai)]. Therefore, the pre-deposit of amount of service is waived. But for the balance amount, the Tribunal held that prima facie case is not made for total waiver in the light of finding of the Commissioner regarding banking commission, professional fees, additional expenses for the crane charges and labour mammol, the importer or exporter is not liable to pay the charges to the respective service providers and further no supporting documents or bills were produced by assessee in respect of afore-said expenses. Predeposit of Rs. 1 lakh ordered.

Decision: - Pre-deposit ordered.
