PJ/ Case Laws/2012-13/1274

Cenvat credit on service tax paid in respect of services of laying down pipeline through which the assessee receives natural gas is allowable even if it is outside the factory.
CASE:  MAHANAGAR GAS LTD Vs COMMISSIONER OF CENTRAL EXCISE, MUMBAI-II

CITATION:2012-TIOL-1308-CESTAT-MUM

BRIEF FACTS:The applicant filed this application for waiver of pre-deposit of duty of Rs.99,74,816/-, interest and penalty. The demand is made by denying the Cenvat credit on service tax paid in respect of laying pipeline through which the applicants are receiving natural gas. In the adjudication order and in the show cause notice, the allegation is that the pipeline is outside the factory; therefore the applicants are not entitled for credit in respect of the service tax paid on the laying of the pipeline.

APPELLANT’S CONTENTION:The applicant relied upon the definition of ‘input services' which includes the service tax paid in respect of inward transportation of inputs and submitted that as they are receiving the natural gas through pipeline, therefore are entitled for the credit.

RESPONDENT’S CONTENTION:The Revenue relied upon the findings of the lower authority to submit that the credit is available in respect of the inputs or input services used in the factory of production.

REASONING OF JUDGEMENT: It is found that the applicants are receiving natural gas through pipeline and as per the definition of ‘input services', the service tax paid in respect of inward transportation of inputs is available as input credit. In these circumstances, prima facie the applicants have a strong case.

DECISION:The stay petition is allowed.

Comment: It is clear from the above decision that Cenvat credit is admissible when the basic conditions are satisfied and the provisions in this regards are not to be interpreted literally.
