PJ/Case Laws/2011-12/1259

Availability of benefit under Notification No. 214-86-CE to jobworker

Case: SAM TURBO INDUSTRIES LTD. V/s COMMISSIONER OF C. EX., COIMBATORE

Citation: 2011 (269) E.L.T. 235 (Tri.- Chennai)

Issue:- Exemption from payment of duty by Jobworker under Notification No. 214/86-CE – available even for finishing work done on incomplete/complete article.

Brief Facts: - Appellant-assessees are manufacturers of Power Driven Pumps for handing liquids other than water and unmachined castings of Iron, steel and stainless steel. Demand against them was confirmed on the ground that the benefit of Notification No. 214/86-CE., dated 25-3-1986 is not available to unmachined castings cleared to job workers for further machining/polishing, as the Notification extends benefit only to the goods manufactured by job workers, while unmachined castings were already manufactured by the assessees themselves.

Reasoning of Judgement: - The Tribunal perused the provisions of Notification No. 214/86-CE and held that the explanation to the Notification lends support to the contention of the assessees that the benefit thereof is admissible to the un-machined castings for the reason that expression "job work" covers finishing of an article or any operation which is essential for the aforesaid process. In other words, even an incomplete article or a complete article which requires finishing by a job worker will be eligible to the benefit of the Notification. Therefore, the impugned order was set aside by holding that the benefit of Notification No. 214/86-CE is admissible to the assessees herein for unmachined castings.

Decision: - Appeal allowed.
