PJ/Case Laws/2011-12/1449

Admissibility of cenvat credit on photocopy/extra copy of invoice verified by range superintendent of input supplier.

Case: UNION OF INDIA v/s HIRA STEELS LTD

Citation: 2011 (273) E.L.T. 370 (Chhattisgarh)

Issue:- Admissibility of cenvat credit on photocopy/extra copy of invoice verified by range superintendent of input supplier.

Brief Facts:- Respondent-assessee availed Cenvat credit on photo copies/ extra copies of invoices issued by Bharat Petroleum Corporation Limited and Steel Authority of India. The invoices were verified by the range superintendent of input supplier.

Tribunal allowed credit on the photocopies of invoices by holding that Modvat/Cenvat credit can be allowed on the basis of photocopy/extra copy of the invoice.

Hence, Revenue has filed this appeal before the High Court.

Appellant’s Contention:- Revenue contended that the Tribunal has allowed Modvat credit to the respondent by relying upon the photocopies of the invoices allegedly issued by the Bharat Petroleum Corporation Limited and Steel Authority of India Limited though the Tribunal could not take cognizance of photocopies in absence of original or duplicate copies of the same issued by the suppliers.

Reasoning of Judgment:- From perusal of impugned order, the High Court observed that the invoices were duly verified by Range Superintendent of B.P.C.L. and S.A.I.L. and the above fact has not been disputed by the department before the Tribunal and the Tribunal, after getting satisfied from the concerned departments has allowed Modvat credit to respondent. It was held that for the purpose of deciding the disputed question of fact, the Tribunal is the final authority.

Decision:- Appeal dismissed.
