SECTION 85 ORDERS OF APPELLATE TRIBUNAL

GST DAILY DOSE OF UPDATION:-

SECTION 85 ORDERS OF APPELLATE TRIBUNAL:-

The appellate tribunal may, after giving the parties to the appeal an opportunity of being heard, pass such orders as it thinks fit, confirming, modifying or annulling the decision or order appealed against or may refer the case back to the first appellate authority or to the adjudicating authority. The appellate tribunal may also grant adjournment for sufficient reasons to be recorded in writing but adjournment will not be given more than 3 times.

The appellate tribunal may amend any order passed by it so as to rectify any mistake apparent from the record, if such mistake is brought to its notice by the Commissioner of GST or the other party to the appeal within a period of three months from the date of the order. It is worth noting that at present, the appellate tribunal is also given the power of rectifying any mistake apparent on record brought to its notice by either of the party to the appeal but the time limit is specified as six months from the date of the order. The time limit of rectifying any mistake apparent on record has been reduced in the proposed GST regime from six months to three months from the date of order.
