GST Update 05.02.2016

SECTION-16: PLACE OF SUPPLY OF SERVICES-PART-I:-

GST DAILY DOSE OF UPDATION:-

SECTION-16: PLACE OF SUPPLY OF SERVICES-PART-I:-

Presently, for determining the place of provision of service, Place of Provision of Service Rules, 2012 are prevalent wherein different situations are being given where the place of provision of service has been specified. On similar lines, in the proposed GST regime, Place of Supply of Services has been incorporated.

The provisions of this section shall apply to determine the place of supply of services. The sub-section (2) states that except if the situation is covered by specific sub-sections, the place of supply of all services made to a registered person shall be the location of the service receiver. Furthermore, sub-section (3) states that except if covered by specific sub-sections, the place of supply of all services made to any person other than a registered person shall be the location of the service provider. It is pertinent to note that the present Place of Provision of Service Rules, 2012 does not distinguish between provision of service to a registered and unregistered person and states that generally, place of provision of service shall be location of service receiver.

The sub-section (4) pertains to place of service in case of immovable property. It states that the place of supply of services in relation to an immovable property including services provided by architects, interior decorators, surveyors, engineers, or services by way of lodging, accommodation by a hotel, inn, guest house, club etc. and including a house boat or any other vessel or by way of accommodation in any immovable property for organising any marriage, official, social, cultural, religious or business function etc. shall be the location at which the immovable property, or boat or vessel is located or intended to be located.

Explanation to this sub-section also mentions that where the immovable property or boat or vessel is located in more than one State, the supply of service shall be treated as made in each of the States in proportion to the value for services separately collected or determined, in terms of the contract or agreement entered into in this regard, or in the absence of such contract or agreement, on such other reasonable basis as may be prescribed in this behalf. It is submitted that the place of provision of service for service provided in relation to immovable property is the place where immovable property is situated. Furthermore, this sub-section is also made applicable to boat or vessel which is not immovable property.

One more point to be noted is that as per present Rule 7 of the Place of Provision of Service Rules, 2012, if service is provided at more than one location, the place of provision shall be the location where the greatest proportion of services is provided. However, the explanation states that in case where immovable property is located at more than one State, tax will be payable proportionately in all States. This provision will definitely increase the complexities and disputes as regards proportion of tax payable.
