GST Update 24.09.2016

HIGHLIGHTS OF THE FIRST GST COUNCIL MEET
 
GST DAILY DOSE OF UPDATION:-
 
 
HIGHLIGHTS OF THE FIRST GST COUNCIL MEET:- The GST Council reached a consensus on three crucial issues being threshold exemption limits, dual control policy and draft compensation mechanism.
 
DUAL CONTROL:-On the issue of dual control, it was decided that businesses with annual turnover of upto Rs. 1.5 Crores will be assessed by States and the assessees with turnover exceeding Rs. 1.5 Crores will be either assessed by Centre or by State based on risk assessment formula. Furthermore, the presently registered service tax assessees will be continued to be assessed by Centre while the new service tax assessees may be assessed by States.
 
DRAFT COMPENSATION MECHANISM:-The Centre is required to compensate States for any loss of revenue in the first five years. The demand of States to take Financial Year 2016 as the base year for measuring losses to States has been accepted and compensation will be paid at regular intervals on quarterly basis.
 
THRESHOLD EXEMPTION LIMITS:- The Council has agreed to an exemption threshold of Rs. 20 Lakhs for all States except North Eastern States. The threshold exemption of Rs. 10 Lakhs in North Eastern States. The impact of the above decisions is tabulated as follows:-
 
TURNOVER LIMIT ASSESSING AUTHORITY REMARKS
Upto Rs. 20 Lakhs State Manufacturers will continue to enjoy exemption. Traders will get additional exemption as threshold exemption under most of VAT Laws is Rs. 10 to 15 Lakhs. Service Tax assessees presently registered will be continued to be governed by Centre.
Above 20 Lakhs but less than Rs. 1.5 Crores State Manufacturers will continue to be governed by States only. Traders will continue to be governed by States. Service Tax assessees presently registered will be continued to be governed by Centre but new assessees may be governed either by Centre or States.
Above Rs. 1.5 Crores Centre or State as per risk assessment formula Manufacturers may be governed by Centre or States but earlier they were governed by Centre only. Traders will also be governed by States or Centre but  earlier they were governed by only States. Service Tax assessees presently registered will be continued to be governed by Centre but new assessees may be governed either by Centre or States.
 
 
The effect of all the above is that manufacturers having turnover greater than Rs. 20 Lakhs but less than Rs. 1.5 Crores will be governed by States and the traders having turnover greater than Rs. 20 Lakhs but less than Rs. 1.5 Crores will be continued to be governed by States. Existing service tax assessees will be governed by Centre. However, new service tax assessees along with traders/manufacturers having turnover exceeding Rs. 1.5 Crores will be governed either by Centre or States as per risk assessment formula. Therefore, traders will be governed by Centre also in GST regime.
