GST Update 13.01.2016

GST WORLDWIDE: INTERSTATE TRADE IN EUROPEAN UNION (EU):-

GST DAILY DOSE OF UPDATION:-

GST WORLDWIDE: INTERSTATE TRADE IN EUROPEAN UNION (EU):-

European Union (EU) comprise of around 28 countries including Austria, Belgium, Bulgaria,Denmark, France, Germany, Greece, Poland, Spain, etc. The manner of levying GST in course of interstate trade is a good example of federal VAT. EU has been following destination principle since 1993. GST in interstate trade in EU works on deferred payment system. This means that when registered seller of one country of EU (say Poland) sells goods to registered buyer in another country in EU (say Belgium) does not pay any tax. In this case, the GST on import is actually paid by registered buyer in Belgium when the goods so imported from Poland are actually sold by him at Belgium. Thus, payment of GST was deferred till the date of sale by the importing registered buyer in EU. However, no input tax credit is available in such a case as no tax was being paid at the time of import. On the other hand, if the goods are sold by registered seller to some unregistered buyer in EU, the tax was to be paid at the time of such sale.

Some experts are of the view that this model is not appropriate and there should be some arrangement like that of clearing house in banks. In such a case, the exports should be subject to GST, i.e. these should be taxed on origin basis and credit should be allowed to importing country/state. Importing states granting such credits would be reimbursed by country of origin that had collected the tax. However, in this system, two countries/states are involved with different jurisdictions. Thus, the complexities would be on higher side.

But despite some favours given to origin based principle, it is a fact on record that the destination principle is the most appreciated principle and is being adopted by a no. of countries worldwide and even India is on the way to adopt the same.
