GST UPDATE ON WAIVER OF LATE FEES FOR FILING OF GSTR 3B FOR THE MONTHS OF AUGUST & SEPTEMBER

GST UPDATE ON WAIVER OF LATE FEES FOR FILING OF GSTR 3B FOR THE MONTHS OF AUGUST & SEPTEMBER

GST UPDATE ON WAIVER OF LATE FEES FOR FILING OF GSTR 3B FOR THE MONTHS OF AUGUST & SEPTEMBER

Late fees levied for delayed filing of GSTR-3B for the month of July was already waived. There were requests moving for similar waiver for the months of August and September also. Now, Notification no. 50/2017 – Central Tax dated 24.10.2017 has been issued in this regard. Further, press release dated 24.10.2017 has been issued to clarify that those tax payers who have already paid the late fees; their Electronic cash ledger will be credited with the amount of late fee so paid. However, this decision still suffers from few drawbacks which are discussed in this update.

• Firstly, the late fees will be re-credited to the head of "late fees" only. In other words, it can be utilized in the payment of late fees only. It cannot be used for paying the CGST, SGST, IGST or any other payments like interest, penalty etc.

• The late filing of returns is rare phenomenon and at present it is on higher side due to technical glitches. This is not going to continue in future, therefore, in majority of the cases, this amount will never be utilized.

• The only option available with the tax payers is to file the refund. But as of now, the refund procedure is not clear. Further, following the long refund procedures for such meagre amounts is not practicable.

• The best possible alternative to these problems is that the government allows the transfer of this amount of late fees to CGST or SGST or IGST, etc. at the choice of the tax payers.

It is worthwhile to mention here that earlier, in VAT, there was a system whereby if any extra payment of tax was made under any head by the assessee, then he was allowed to transfer and use such amount in other heads after giving an intimation to the department. It is also suggested to the government to adopt such a system in GST to reduce the plight of assessees.
