GST Update on waiver of late fees for delayed filing of return part-14

GST Update on waiver of late fees for delayed filing of return part-14

Amongst the various recommendations made by the GST Council in its 31st Meeting held on 22.12.2018, one of the recommendations is the waiver of late fees for all the taxpayers as regards filing of GSTR-1, GSTR-3B and GSTR-4 for the months/quarters July, 2017 to September, 2018 that are furnished after 22.12.2018 but on or before 31.03.2019. This proposal is beneficiary for the assessees who have defaulted in filing their monthly/quarterly returns and have not filed returns upto 22.12.2018 and puts the law complying assessees at disadvantageous position. The assessees who have filed their returns prior to 22.12.2018 have paid late fees for delay in filing GST returns. However, the recommendation of the GST Council Meeting seeks to provide benefit of waiver of late fees who have filed their returns after 22.12.2018 but before 31.03.2019. No clarification is available as of now regarding the refund mechanism for the assessees who have already filed their GST returns after payment of late fees.

As observed from the past practise, when the late fees on filing of GSTR-3B for the month of August and September, 2017 was waived, the assessees who had already paid the late fees had received credit back under late fees head. It was also represented that the credit should be done in the tax head of the electronic cash ledger so that the same may be used for discharging GST liability as when credit is given under late fees head, the only option available with the assessee is to file refund claim which is cumbersome process. Since the assessees who had paid late fees before waiver granted by the government were refunded the late fees paid, it is hoped that similar practise would be followed as regards the decision to waive late fees for the period July, 2017 to August, 2018.
