GST update on ITC admissibility on motor vehicles supplied on lease basis 162/2020-21

GST update on ITC admissibility on motor vehicles supplied on lease basis 162/2020-21

The issue regarding admissibility of ITC on motor vehicles is a point of dispute in the GST era as the ITC can be availed on motor vehicles only in specific situations. Recently,  M/s Dream Road Technologies Pvt Ltd. filed application for advance ruling before AAR Haryana to seek clarification as to admissibility of ITC on motor vehicles supplied by them to their customers on operating lease basis. The outcome of this decision is the subject matter of discussion of our present update.

The applicant proposes to purchase motor vehicles and provide the same on operating lease basis and contended that the restriction contained in section 17(5) of CGST Act, 2017 will not be applicable in the present case as the motor vehicles on which ITC was availed are used in further supply of services of lease provided by them. The applicant also placed reliance on the advance ruling pronounced on similar issue in favour of M/s Nursing Transport wherein the ITC was allowed.

AAR observed that according to the provisions contained in section 17(5) of the CGST Act, 2017,  ITC is not available in respect of motor-vehicles for transportation of persons having seating capacity of not more than 13 persons (including driver) except when they are used for making specified taxable supplies namely (a) further supply of such motor-vehicles, (b) transportation of passengers or (c) imparting training for driving of such motor-vehicles. However, in the present case, as the motor vehicles were used for further supplying them on lease, they were covered in the exception as stated in (a) above. AAR also relied on the decision given in the case of M/s Nursing Transport pronounced byAAR Madhya Pradesh wherein the ITC was allowed. It was held that as the applicant is engaged in supply of motor vehicles on monthly lease rent to its customers - which qualifies as supply and attracts GST,  the applicant is eligible to avail ITC of GST paid on motor vehicles subject to fulfilment of conditions as laid down under the CGST Act.

The above decision has been rendered by interpreting the provisions contained in section 17(5) of the CGST Act, 2017 in true sense. The term ‘supply’ in GST covers both supply of goods and services so the exception contained in section 17(5) regarding further supply of such motor vehicles would not only include supply of motor vehicles by automobile dealers but also supply of vehicles on lease. The above decision would be very helpful for the assessees as it seeks to analyse the restriction of ITC contained in section 17(5) in correct manner.
