GST Update on health services
At the time of implementation of GST, there were a lot of muddled opinions on the scope of composite supply and mixed supply. It was opined by many scholars that when two taxable services are naturally bundled then only composite supply but if there are two services and one is taxable and other is exempt then it will be termed as mixed supply only. In this update we shall study whether the Health care services is exempt or composite supply?
 Health care services are being exempt by way of Entry No. 74 of Notification No. 12/2017- Central tax (Rate) dated 28-06-2017. But the question that raised here was that what rate of tax shall apply on other services provided to patients like stay facility, medicines, consumables, surgical and implants, dietary food and other surgeries/procedures along with health care services. Whether this is composite supply under Section 2(30) of CGST Act or mixed supply as defined under Section 2(77)?
In order to qualify as Composite supply there should be a combination of two or more taxable supplies. But in case of health care services, one service included is exempt and other is taxable supplies. The CBIC vide Circular No.32/06/2018-GST dated 12.02.2018 clarified that health care services are exempt.
 
 
The same analogy was also underlined by various Advance Rulings Verdict and it was emphasized that health care services along with other services by Hosiptals is composite supply and exempt from tax. We put forward to you decisions of some of such advance Rulings.

Hence it is clear that there should not be both taxable services to be classified as composite supply. One taxable supply and one exempt supply naturally bundled together can be classified as composite supply.
