GST Update on directions issued by NCLT to restore E Way Facility

GST Update on directions issued by NCLT to restore E Way Facility

GST Update on directions issued by NCLT to restore E Way Facility:

Techno Electronics Limited a Corporate Debtor under NCLT, has been barred from generating e-way bill due to the provisions of Rule 138E of CGST Rules and SCN has been issued for the cancellation of Registration. The Applicant has requested the NCLT for

1.    Restoration of E Way Bill facility.

2.    Filing of Returns manually.

It was held by NCLT that the applicant can submit the return GSTR-3B manually for the moratorium period due to the technical glitches on GST portal. It doesn’t allow filing the next month’s return unless the previous return is filed. The party was ready to file this year return but the portal is not allowing the same without filing earlier returns. Further it has also directed to restore the e-way facility and also not to take coercive action against the corporate debtors.

The question that arises from the above decision is Whether NCLT can cover proceedings pending before GST Authorities? It is to be seen that NCLT has powers to overcome GST Acts and provisions. This rulings has underlined the same. Another point is to be seen that NCLT authority has ordered to accept the manual returns. But portal does not allow the same and how to incorporate the same in the portal and not to charge interest and late fee. We have seen that portal is working in its own way and authorities are not allowed to incorporate other things. How this order will be implemented? It is interesting to see the same.
