GST UPDATE ON COMPOSITION SCHEME

GST UPDATE ON COMPOSITION SCHEME
GST UPDATE ON COMPOSITION SCHEME

According to rule 3(1) of the CGST Rules, 2017, a person migrating to GST regime is liable to file FORM GST CMP-01 prior to appointed day but not later than 30 days from such date for opting composition scheme under section 10 of the CGST Act, 2017. Therefore, all the migrants to GST regime whether they were operating under Cenvat scheme in existing laws or were availing benefit of compounded levy scheme, if they opt to avail the composition scheme under section 10 of CGST Act, they will be required to file declaration in form GST CMP-01.

Furthermore, according to rule 3(4) of CGST Rules, 2017; any person who files GST CMP-01; he shall be required to furnish Form GST CMP-03. In this form, the details of stock, including the inward supply of goods received from unregistered persons, held by him on the day preceding the date of opting composition scheme are required to be filed.

Suppose, if the person was operating under compounded levy scheme in old laws, he will be required to file form GST CMP-01 and consequently, he will also be required to file FORM GST CMP-03, which is stock statement of goods held on the day preceding the date of availing option. It is worthwhile to mention here that the form GST CMP-03 is required to be filed for the purpose of ascertaining the amount of credit that is required to be reversed on availing option of composition scheme. However, if a person was registered under compounded levy scheme under Central Excise Act, 1944 no credit was being availed by him as he was not eligible to avail any credit. When no credit was admissible to him, the question of reversing the same does not arise at all. Therefore, there is no need of filing any CMP-03.

However, the CGST Rules, 2017 does not provide any exception to such persons. Therefore, as of now, these persons are also required to file GST CMP-03 regardless of the fact that it is a redundant exercise.
