GST DAILY DOSE OF UPDATION ON E-WAY BILL


The government has recently issued notification no. 27/2017 dated 30th August’2017 to notify the provisions related to E-way bill. An e-way bill is required to transport any item worth more than Rs 50,000 within the country. The provisions inserted in CGST Rules, 2017 regarding the e-way bill are summarized as follows:-

• E-way bill is to be filed by every registered person who causes movement of goods of a value exceeding Rs. 50,000/- in relation to supply, reasons other than supply or by virtue of inward supply from unregistered dealer. The said details are to be furnished before commencing the movement of goods in part A of Form GST EWB-01.

• Where the goods are transported by the registered person as a consignor or the recipient of supply as the consignee, whether in his own conveyance or a hired one or by railways or by air or by vessel, the said person or the recipient may generate the e-way bill in FORM GST EWB-01 electronically on the common portal after furnishing information in Part B of FORM GST EWB-01.

• Where the above referred provision of goods transported by registered person as consignor or recipient of supply are not applicable and the goods are handed over to a transporter for transportation by road; the registered person shall furnish the information relating to the transporter in Part B of FORM GST EWB-01 on the common portal. In such a case, the e-way bill shall be generated by the transporter on the said portal on the basis of the information furnished by the registered person in Part A of FORM GST EWB-01. Transporter or registered person, both at their own option, can generate the e-way bill even if the consignment value is less than Rs. 50000/-.

• However, details of conveyance may not be updated in e-way bill where goods are transported for a distance of less than 10 km within the State or Union Territory;

• In case multiple consignments are intended to be transported in one conveyance, the transporter may indicate the serial number of e-way bills generated in respect of each such consignment and a consolidated e-way bill in Form GST EWB-02 may be generated;

• An e-way bill or a consolidated e-way bill generated under this rule shall be valid for the period as mentioned in Table below from the relevant date, for the distance the goods have to be transported.

If the conveyance has to cover distance upto 100 km, then the E-way bill will be valid for 1 day; for every 100 km or part thereof thereafter, the validity will be increased for a period of 1 more additional day.

No e-way bill will be required in following cases:–

i) In case of 154 goods as specified in the schedule to notification.
ii) Where goods are transported by non-motorised conveyance,
iii) where goods are transported from port /airport / air cargo complex / land customs station to inland container depot / container freight station for customs clearance, and
iv) in respect of movement within notified areas;

Also, Rules 138A, 138B, 138C and 138D have been inserted to prescribe the documents and conveyances and rules regarding inspection and verification of goods as well as facility for uploading information regarding detention of vehicle.
