Difficulty faced in complying with the amended provisions.

Difficulty faced in complying with the amended provisions.
Difficulty faced in complying with the amended provisions.
Government has made amendment in CGST act by inserting new Section 49 A which provides that the input tax credit on account of central tax, State tax or Union territory tax shall be utilised towards payment of integrated tax, central tax, State tax or Union territory tax, as the case may be, only after the input tax credit available on account of integrated tax has first been utilised fully towards such payment. Thus, it is necessary to exhaust credit of IGST to pay taxes, before credit of Central tax, State tax or Union territory tax can be used.
Due to this amendment in Section 49A cited supra, it has been seen that the CGST credit will be remaining with assesse but he has to pay in cash SGST amount. The trade and industry has represented against this provision. This is due to the fact that the credit is still lying with them but they have to pay the taxes in cash. The earlier provision only provided for payment of taxes when the credit was exhausted.
But there is another problem in implementation of changes in this provision. This provision is effective from February 1, 2019. But the utility is not available on online portal to offset liability as per new provision. If the assesse does it manually and tries to file the return but the portal does not allow them to file the return. The return can be filed if the IGST is utilized for payment of IGST, CGST for CGST and SGST for SGST as per old provisions.
Even the assesses have represented the matter before GST authorities as well as on GST helpline but there is no solution of the same. Even after raising the ticket, the issue was not resolved and the email suggested that the assesse should wait for some days. The last date of filing returns is approaching (i.e. March 20) and taxpayer was finding it difficult to wait for the same. The department needs to urgently address the concern and clarify on the validity of  the returns filed by the taxpayers as per the old provisions.
The assesse has been left with no option and hence they are filing the returns as per old provisions and giving letter to this effect to the department.
