Daily Dose of GST update on FAQ in seminar with Industries

In previous GST update we informed about the questions asked in seminar. In this session we are informing about some more questions:

Question: Is the provision regarding TDS in GST same as that which is there in Income Tax?
Answer: The provision regarding TDS in GST is different from that there in Income Tax.

Question:-Is TDS required to be deposited separately? Further if cash payment is also made, then won’t the same invoice be paid twice?
Answer:-No, the amount of TDS that is deducted, that will be added to your credit ledger and you won’t be required to pay that amount.

Question:-What is the difference between TDS and RCM (Reverse Charge Mechanism)?
Answer: In RCM, the person who is receiving the service is liable to pay tax whereas in the case of TDS, in respect of the goods or services on which the government has imposed TDS, the person will have to deduct TDS from the bill and deposit it in the supplier’s registration.

Question: On which value and at which rate will the TDS be deducted?
Answer: The provision of TDS has been made applicable for central or state government, local authority or government agency. Apart from them, all those who will be notified by the central or state government will have to deduct TDS @ 1%. TDS will be deducted only in respect of the bills having amount greater than 10 lakh.

Question: When is TDS required to be deposited?
Answer: TDS will have to be deposited withen 10 days and in respect of it ,separate monthly returns will also have to be made.

Question: Will the deductor of TDS provide any document?
Answer: The deducter of TDS will give a certificate to the supplier withen 5 days. If he doesn’t do so, penalty imposed will be 100 for each day for which the default continues.
