Bi-chem India Pvt Ltd vs Union of India
GST UPDATE
Appeal/Petition No.: W.P.(L) 7331/2026
Court/Authority: THE HIGH COURT OF JUDICATURE AT BOMBAY ORDINARY
                                ORIGINAL CIVIL JURISDICTION
Case Title:  Bi-chem India Private Limited v. Union of India
Outcome: In favour of Appellant
Judgement Date: 11/03/2026

BRIEF FACTS OF THE CASE:
M/s Bi-chem India Pvt Ltd. received an SCN dated 18.02.2026 and a recovery notice and provisional attachment dated 03.02.2026 was passed by the revenue department. Writ was filed by the petitioner to look into the validity of the impugned SCN and Impugned recovery notice and provisional attachment, and to seek restoration of registration of the registered person. Further relaxation was sought to forthwith defreeze the bank accounts of the petitioner.
QUESTION BEFORE HON’BLE COURT:

  • Whether department is correct in cancelling registration without due procedure?
  • Whether recovery proceedings can be initiated without proper adjudication arbitrarily without following procedure as specified in the law?
Brief Arguments by Appellant (Registered Person):
The Petitioner contended that the actions of the department particularly suspension of registration and initiation of recovery were undertaken without following the lawful procedure and principles of natural justice. It was emphasized that:

  • The registration was suspended arbitrarily, without proper verification of facts or adherence to prescribed legal procedure.
  • No adequate opportunity of hearing was granted prior to taking adverse action.
  • The recovery proceedings were initiated prematurely, without proper adjudication or consideration of the Petitioner’s submissions.
  • The department failed to apply due process of law, including verification of records and consideration of the Petitioner’s contentions.
Accordingly, the Petitioner sought restoration of registration and insisted that any further action must be taken only after granting a fair hearing and following due process.
Findings & Judgement:
The court observed that lawful procedure should be followed in regarding to coercive actions of suspension, recovery and provisional attachment and order should be passed in accordance with law. The Court emphasized the importance of Natural justice, Fair hearing and Procedural compliance.
Accordingly, the suspension of GST registration was withdrawn, and the Petitioner’s registration was ordered to be restored immediately. The Court held that the Petitioner must be given a proper opportunity of hearing on the Show Cause Notice and the recovery notice shall not be acted upon, and any recovery can be initiated only after following due process of law.
