BRIEF FACTS OF THE CASE:
The facts of Aerocom Cushions Private Limited v. Assistant Commissioner (Anti Evasion) case are very much similar to M/s Hindustan Equipment Craft in which High Court of Bombay (Nagpur Bench) reconfirmed that GST cannot be imposed on the assignment of leasehold rights of a plot of land allotted by State Industrial Development Corporation for a long term in favour of another person. Being aggreived by the decision of Hon’ble Bombay HC, Revenue department preferred a special leave petition (SLP) in the case of Assistant Commissioner (Anti Evasion) & Anr. v. Aerocom Cushions Private Limited .
Judgement of Hon’ble Supreme Court:
It was held that the special leave petition by the Revenue Department was dismissed by the Hon’ble Apex Court ‘in limine’.
