Extension of due date of filing GST returns

Extension of due date of filing GST returns

Today’s GST update seeks to inform that due date of filing GST return i.e. GSTR 1 and GSTR 3B, specific to certain conditions has been extended. Government has issued several notifications in this regard.
Notification no. 43/2018-Central Tax ,dt. 10-09-2018 seeks to extend the due date for filing of FORM GSTR - 1 for taxpayers having aggregate turnover up to Rs 1.5 crores. For this purpose quarter wise due date of filing GSTR 1 is clearly mentioned in the table below:

For registered person having aggregate turnover upto Rs.1.5 Crores in Kerala, or whose principal place of business is in Kodagu (Karnataka) and Mahe (Puducherry),the due date for furnishing Form GSTR-1 for the quarter July,2018 to September,2018 would continue to remain as 15th November,2018.

Notification no. 44/2018-Central Tax dt 10.09.2018 seeks to inform that the due date for furnishing FORM GSTR-1 for the period from July,2017 to September,2018 has been extended till 31st October,2018 for all the registered persons having aggregate turnover above Rs.1.5 Crore including the registered person in Kerala or whose principal place of business is in Kodagu(Karnataka) and Mahe(Puducherry).

Further, for the purpose of newly migrated taxpayers obtaining GSTIN vide notification no. 31/2018- Central Tax dated 06.08.2018, the last date for filing GSTR 1 as well as GSTR 3B for the months of July,2017 to November,2018 has been extended till 31.12.2018.Thus notification no. 45,46 and 47/2018 Central Tax dated 10.09.2018 have been issued for the purpose of extension of due date for furnishing GSTR 3B for all the newly migrated taxpayers.

Notification no. 48/2018-Central Tax dated 10.09.2018 seeks to clarify that registered person who was not able to file FORM GST TRAN 1 on due date i.e. 27th December 2017 on account of some technical difficulties and in respect of whom the council has made a recommendation for extension, the date may be extended by a further period not beyond 31st March,2019 by the commissioner.

Also for the purpose of greater benefit of the tax payers government has decided to waive the late fee payable for delayed furnishing of form GSTR 1 for the period from July 2017 to September 2018 till 31.10.2018.

This step of the government will definitely increase the number of assessees filing returns in GST.
